Effective date: October 19, 2026
These Terms of Use (“Terms”) govern your access to and use of k13.ca (the “Website”), operated by K13 Marketing (“K13,” “we,” “us,” or “our”) in Calgary, Alberta, Canada. By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Website purpose and no professional advice
The Website provides general information about K13 and our web design, development, digital marketing, social media, video, and creative services. Website content is for general informational purposes only. It is not legal, financial, marketing, technical, or other professional advice tailored to your circumstances. You should assess your own needs and obtain appropriate advice before making decisions.
2. Inquiries and service agreements
Submitting a form, email, telephone call, WhatsApp message, or consultation request does not make you a K13 client and does not create a contract, agency, partnership, or fiduciary relationship. Any services we provide will be governed by a separate proposal, statement of work, service agreement, or other written agreement accepted by both parties. If a signed or accepted service agreement conflicts with these Terms, that agreement governs the services it covers.
We may decline an inquiry or project at our discretion. Information, pricing, timelines, examples, and service descriptions on the Website are general and may change; they are not a binding quote or promise unless included in a written agreement.
3. Acceptable use
You may use the Website only for lawful purposes. You must not:
- use the Website in a way that violates applicable law or another person’s rights;
- attempt to gain unauthorized access to the Website, its systems, or related accounts;
- interfere with, disrupt, damage, or impair the Website or its security;
- introduce malware, harmful code, spam, or deceptive material;
- scrape, copy, harvest, or extract Website data by automated means without our written permission; or
- misrepresent your identity or affiliation when contacting us.
4. Intellectual property
The Website and its content—including text, graphics, logos, design, photographs, video, illustrations, and code—are owned by K13 or its licensors and are protected by intellectual property laws. You may view and print reasonable portions for your personal or internal business reference. You may not reproduce, modify, distribute, publicly display, commercially exploit, or create derivative works from Website content without our prior written permission, except as permitted by law.
Third-party names, logos, and project examples shown on the Website belong to their respective owners. Their appearance does not necessarily imply endorsement or affiliation. Portfolio examples are illustrative of past work and do not guarantee particular results for another project.
5. User-submitted information
You retain ownership of materials you submit to us. You give K13 permission to use, copy, and review those materials as reasonably necessary to respond to your inquiry, prepare a proposal, or provide requested services. You represent that you have the rights and permissions needed to provide those materials and authorize this use.
6. Third-party links and tools
The Website may link to or integrate third-party websites, platforms, or tools. K13 does not control and is not responsible for third-party content, availability, terms, privacy practices, or services. Your use of those services is at your own risk and subject to their terms.
7. Website availability and accuracy
We may change, suspend, or discontinue any part of the Website at any time. We do not guarantee that the Website will always be available, uninterrupted, secure, error-free, or compatible with every device or browser. We make reasonable efforts to keep Website information current, but do not warrant that it is complete, accurate, or up to date.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without warranties or conditions of any kind, whether express, implied, or statutory, including implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
9. Limitation of liability
To the fullest extent permitted by law, K13 and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage, or for loss of profits, revenue, business, data, goodwill, or opportunity, arising from or related to your use of, or inability to use, the Website or its content, even if advised that such loss or damage was possible.
To the fullest extent permitted by law, K13’s total liability for claims arising from or related to the Website or these Terms will not exceed CAD $100. This limit does not apply to liability that cannot be limited under applicable law. These Terms do not limit rights or remedies you may have under applicable consumer protection legislation.
10. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless K13 and its owners, employees, contractors, and suppliers from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Website, your breach of these Terms, or materials you submit that infringe another person’s rights. This does not apply to the extent a claim results from K13’s own negligence, wilful misconduct, or other liability that cannot lawfully be shifted to you.
11. Governing law
These Terms are governed by the laws of Alberta and the applicable laws of Canada, without regard to conflict-of-law rules. You agree that courts located in Alberta will have jurisdiction over disputes related to these Terms or the Website, subject to any mandatory rights you may have under applicable law.
12. Changes to these Terms
We may revise these Terms by posting an updated version on this page and changing the effective date. The revised Terms apply from the time they are posted. Your continued use of the Website after changes are posted means you accept the revised Terms.
13. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with any applicable written service agreement, form the entire agreement between you and K13 regarding Website use.
